finally came out publicly with a bipartisan, big, tough plan, a framework for how to deal with our very real challenge with our record deficits and debt. it's my hope that the senate will consider cut, cap and be balance, defeat it and then put a responsible plan on the floor, one that shares the sacrifice across all the areas of our budget and that puts forward the kind of framework that everyone can support. bill: okay. on the cut, cap and balance, so you agree with harry reid that this is a waste of time on a balanced budget. why would a balanced budget amendment when polls show 72% of those surveyed favor it, why would you be opposed to that, senator? >> i don't speak for leader reid, obviously, but what i think the leader was suggesting was that with ten days left until we default on america's mortgage, we should be focusing on things that have a very real chance of passage in both houses and that can avoid the catastrophic consequences of defaulting on america's debt. i think leader reid and many of us in the senate are concerned that if we simply keep ping-ponging back and forth

, indeed. they raised the stakes earlier on, making a big deal saying he no longer wanted to work with the white house, and yet we're hearing he's going to be at the white house tomorrow morning for more meatings. how is the white house iraqing to this? >> there's a lot of talk about the fact the president has put in repeated calls to speak eer boehner as the president tells it, in order to get a response. the white house made an outreach, an overture of the outline, and the president called speaker boehner's office first, and was told that speaker boehner wasn't available to talk to the president. this is not your stand protocol in president. you make yourself available to talk to the president or shortly thereafter. there is frustration about that expressed here, but there is still an openness and a willi willingness on both sides to negotiate because everybody wants to get the debt ceiling raised, and here, also, they say maybe this obama/boehner framework could be the deal in the end, so it's still not off the table from this perspective. >> you say there's a willingness on bo

of the house. obviously, they don't agree on a number of issue. their big differences and principle differences. each gentleman was convinced there was a way to reach compromise. we came very close. that involved tough political decisions. it included a willingness to cut deeply in our discretionary spending. a willingness to reinform our entitlement programs and a willingness by republicans to find savings in our pentagon budget and saving tlus tax code to raise revv neufville that is what was on the table. we came very close. and we never walk away from those negotiations. we never issued any ultimatums and we believe that that grand compromise is still available if there is political will to do it. the reason why it ended, we brief, it is politically painful for everybody. the president realized he would take a lot of political heat if we got this grand bargain from his own party. certainly the speaker of the house might have. the president was willing to do that because he thought it was the right thing to do. we implore the speaker and other republicans to be willing to do that as well. lo

this morning. a fire at one of the apartment complexes at the big rossmoor retirement community in walnut creek. look at that footage. it started at 6:45 last night. fire crews stopped it from spreading to nearby buildings and luckily no serious injuries reported. >>> gay and lesbian military veterans joined the lgbt community here in san francisco to celebrate the end of "don't ask, don't tell." yesterday, president obama formally ended the ban on gays in the military that has stood for nearly a century. >>> tomorrow is hand-holding day at the contemporary jewish museum in san francisco. that is going on from 9 a.m. to noon. it's in response to an incident last week in which a security guard told a lesbian couple that hand-holding was not allowed. the museum says the guard's actions do not reflect museum policy. >>> the san francisco medical examiner's finding that suspect harding apparently killed himself has further inflamed people in the bayview. you might remember this story. 19-year-old kenneth harding who you see there was shot while being chased by police through the bayview last weeken

't that right? >> anser. >> reporter: that's right. in fact, the big one was bryan stow. he had emergency surgery on sunday to relieve pressure on the brain. he is hospitalized here at san francisco general. meantime, the two suspects made their first court appearance on monday in los angeles. authorities say 29-year-old louie sanchez and 30-year-old marvin norwood are both the lead suspects in the bryan stow beating case that left him with brain damage. prosecutors say the two men bragged about the attacks to coworkers but told everyone to keep quiet. monday in court they didn't enter a plea. they are charged with three felony counts of assault, battery and mayhem. mayhem is the charge for disabling or disfiguring a victim. prosecutors say both men have a history of violence and problems with the law. they are calling them public safety threats. louie sanchez allegedly had past problems including drunk driving, evading police, and carrying a loaded gun in public. also charges of domestic violence. marvin norwood has a history of domestic violence. when police searched his house they foun
